Chapter 7 Bankruptcy Basics

Under Chapter 7 of the United States Bankruptcy Code, debtors can eliminate a majority of their unsecured debt. While it does not rid debtors of all financial obligations (e.g., child support payments and tax liability), it does reduce the financial pressure of high credit card debt, medical bills and other steep monthly payments. Please note, while you may have to liquidate certain assets under Chapter 7 bankruptcy, you will more than likely be able to keep your home, your car and your valued household possessions.

Filing for Chapter 7 bankruptcy stops all creditor actions against you, including harassing phone calls and letters, wage garnishment, repossession or other legal actions. It can also buy you enough time to discuss your financial future with an experienced lawyer and temporarily halt foreclosure.

Do You Qualify for Chapter 7 Bankruptcy?

The federal bankruptcy laws changed in 2005, making it more difficult for people to qualify for Chapter 7 bankruptcy. However, if you have a high amount of unsecured debt and little dependable income, you will more than likely be able to file.

You will be required to take a bankruptcy means test to determine if Chapter 7 is right for you. If you have a steady, reliable income and are able to afford some payments, then Chapter 13 bankruptcy may be a better option.
