What is Chapter 13 Bankruptcy?
Under Chapter 13 of the United States Bankruptcy Code, a debtor can reorganize and consolidate debt into a single monthly payment that is divided by a bankruptcy trustee among creditors. The amount of this monthly payment is significantly lower than the combined total of payments owed by the debtor. This payment plan will usually last a period of three to five years, after which time all remaining debts will be forgiven.
The benefits of filing for Chapter 13 bankruptcy include:
- Achieving debt relief while being allowed to keep your home, car and other assets (so long as you can make the payments)
- Stopping all creditor actions, including foreclosures
- Stopping creditor harassment
